OBJECT AND AREA OF APPLICATION
These general conditions are designed to regulate the commercial relationship between the Economic Promotion and Tourist Department of the Consell Comarcal del Baix Empordà and you (hereinafter the Customer), concerning all the transactions made via the website www.visitemporda.com (hereinafter the website), which is owned by the Consell Comarcal del Baix Empordà, with registered address at Carrer dels Tarongers, 12 – 17100, La Bisbal d’Empordà, tax ID number P6700009A, Tel. (+34) 972 642 310 and e-mail address consell@baixemporda.cat.
PRODUCTS AND PRICES
The prices applicable to each product are those indicated on the website on the date of the order, all of which include Value Added Tax (hereinafter VAT). In the case of delivery of goods to countries that do not belong to the European Union, the Consell Comarcal del Baix Empordà shall not take on the cost of the taxes and customs duties for these countries, which shall be met by the customer. Delivery expenses and the corresponding VAT will be indicated before confirming the order.
ORDERING PROCESS
Customers will select the product(s) they wish to purchase, which they will add to their shopping basket. Once they have chosen the article(s) they will then go to the payment section/page where they will be able to choose between two methods of payment. Once they have completed the purchase, they will receive a notification by e-mail within a maximum of 24 hours confirming acceptance of their order. On reception of the product(s), they will receive a purchase note or an invoice, if they have requested it.
By confirming the order, the customer declares that he accepts each of the general conditions given therein. Any modifications or changes that may occur after in the general conditions clauses will not be applicable to them. For legal reasons, we would inform you that the documents by means of which purchases are formalised are filed electronically.
DELIVERY AND RETURNS
Deliveries will be sent to the delivery address the customer indicates, within a maximum of 7 working days in the case of deliveries to Spain and 20 working days for deliveries abroad.
Customers may select the form of delivery from those offered depending on the delivery area. It should be taken into account that the delivery deadlines, the quality of the service, the delivery point and the cost will vary according to the kind of transport. The delivery date to the customer's address depends on the availability of the product chosen and the area to which it is to be delivered. Before confirming orders, customers will see information about approximate delivery deadlines. The transport deadlines may vary as a result of unforeseen circumstances within the couriers or difficulties in delivering the goods.
If the customer should not receive the order within the deadline indicated, he should contact the Tourist Service of the Economic Promotion and Tourist Department of the Consell Comarcal by calling (+34) 972 642 310 or by sending an e-mail to turisme@baixemporda.cat.
Customers may cancel their order at any time and at no cost as long as they inform us of their decision before the order has been handed on to the haulage company for delivery. Otherwise, the customer will have to wait to receive the order before proceeding with its return. Once the customer has received the goods, he will have a period of seven working days from the date of receipt to cancel the contract. The customer shall inform the Tourist Service of the Consell Comarcal, by any means he considers to be convenient, of his wish to carry out the right to cancel the contract, indicating the reference number of the product and the purchase date.
On returning the goods he should include the delivery note and, if relevant, the invoice issued. The customer will be responsible for the return delivery expenses. Customers may return any article that they have acquired within this deadline, as long as the product has not been opened or used and still has its seal. In the case of maps, they may not be returned once their wrapping has been opened.
If a product reaches a customer broken, damaged or in poor condition, the Tourist Service of the Consell Comarcal will take care of collecting it from the customer's address and replacing it with another one in a correct state, at no additional expense.
PAYMENT METHODS
Users may pay using a choice of two methods.
1.- Credit or debit card. Thanks to a secure payment gateway with “la Caixa”, you can carry out your purchases with full guarantees. Payment is duly registered and the Consell Comarcal will proceed to send you your order.
2. Bank transfer: This can be done directly by means of paying in or transferring the amount to the account that the Consell Comarcal has for the virtual store. Once payment has been verified, the order will be prepared and sent. The Consell Comarcal will keep in contact with the customer, informing him about the situation of his order, at all times.
SECURITY AND DATA PROTECTION
The entire purchasing process is carried out in a secure environment. Payments made by credit card are transactions carried out through the SERMEPA Virtual POS on a Secure Server and do not involve any additional charge at the end of the order.
The software of this Secure Server is the standard for the industry and is among the best security systems available today for commercial transactions on the Internet. The program encrypts the number of your credit card, meaning that this information cannot be intercepted in a legible way when circulating through the Internet.
Customers' data is included in a computerised file belonging to the Consell Comarcal del Baix Empordà created for managing customers of products sold from the Tourism Service of the Economic Promotion and Tourist Department. This data shall not be used for any other purpose without the previous consent of the customer. To carry out their rights to access and rectify data, oppose its processing and cancel it, customers may write to the Consell Comarcal del Baix Empordà - Promoció Econòmica i Turisme, whose address is given on this page.
The Consell Comarcal, the manager of the virtual store, does not get to know the number or any other information about the credit card. At all times, SERMEPA, a financial association which carries out the entire payment process for the orders, will be the only party that has access to this information.
